HMA Games - Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the websites, mobile games, applications, and related services provided by Hüdai Mahmut Avcı, operating under the name HMA Games ("HMA Games," "HMA," "we," "us," or "our").

Our websites, games, applications, and related services are collectively referred to in these Terms as the "Services."

By accessing, downloading, installing, or using any of our Services, you acknowledge that you have read and understood these Terms and agree to be bound by them.

If you do not agree to these Terms, you should not access or use the Services.

These Terms apply together with any additional terms, policies, or rules that may apply to a particular Service, including our Privacy Policy.

2. Binding Effect and Changes to These Terms

These Terms constitute a legally binding agreement between you and HMA Games regarding your access to and use of the Services.

By accessing, downloading, installing, or using the Services, you agree to comply with these Terms.

We may update these Terms from time to time to reflect changes to our Services, features, business practices, legal requirements, or other operational reasons.

When we make material changes to these Terms, we will update the Effective Date and provide additional notice where required by applicable law. If applicable law requires your consent to a particular change, we will obtain that consent before the change becomes applicable to you.

If you do not agree to updated Terms, you should discontinue use of the Services.

These Terms, together with our Privacy Policy and any additional terms or policies applicable to a particular Service, constitute the agreement between you and HMA Games concerning your use of the Services and supersede any prior agreements or understandings concerning the same subject matter.

If you materially violate these Terms, we may take reasonable action, including restricting, suspending, or terminating your access to some or all of the Services, subject to applicable law and the circumstances of the violation.

3. Privacy

Your privacy is important to us.

Our collection, use, disclosure, storage, and other processing of Personal Information in connection with the Services is governed by the HMA Games Privacy Policy.

The Privacy Policy explains, among other things:

  • The types of information that may be collected when you use the Services;

  • How and why that information may be processed;

  • How information may be disclosed to service providers and other third parties;

  • The privacy choices and rights that may be available to you; and

  • How you can contact us regarding privacy-related questions or requests.

By using the Services, you acknowledge that you have been provided with access to the HMA Games Privacy Policy.

Where applicable law requires consent for a particular data processing activity, such consent will be requested separately where required.

4. Age Requirements

The Services are not directed to children under the age of 13.

You must be at least 13 years old, or the minimum age required by applicable law in your jurisdiction, to use the Services independently.

If you are under the age of legal majority in your jurisdiction, your parent or legal guardian should review these Terms with you and, where required by applicable law, authorize your use of the Services.

You may not use the Services if applicable law prohibits you from doing so.

If HMA Games becomes aware that a child has provided Personal Information in violation of applicable law, we will take appropriate steps in accordance with our Privacy Policy and applicable legal requirements.

Parents or legal guardians who believe that a child has provided Personal Information to HMA Games in violation of applicable law may contact us at hudaimahmut@yandex.com.

5. Description of the Services

HMA Games develops and provides mobile games, applications, websites, and related online services designed for entertainment and gaming purposes.

Depending on the particular Service, features may include gameplay progression, virtual currency and virtual items, in-game purchases, advertisements, leaderboards, player profiles, events, challenges, and other game-related features.

Certain features of the Services may require an internet connection or access to third-party platform services.

HMA Games may add, modify, update, suspend, or discontinue features of the Services from time to time, subject to applicable law and these Terms.

The availability of particular features may vary depending on the game, device, operating system, geographic location, platform, or version of the Service.

6. Your Obligations

When using the Services, you agree to use them lawfully, fairly, and in accordance with these Terms.

You agree that you will not:

  • Use the Services in violation of applicable laws or regulations;

  • Access or use the Services through unauthorized methods;

  • Cheat, hack, exploit, manipulate, or otherwise interfere with the intended operation of the Services;

  • Use bugs, glitches, vulnerabilities, automation, bots, modified software, or unauthorized third-party tools to obtain an unfair advantage or disrupt the Services;

  • Attempt to reverse engineer, decompile, circumvent, or bypass security, technical restrictions, or access controls, except where such activity is expressly permitted by applicable law;

  • Transmit viruses, malware, malicious code, or other harmful material;

  • Interfere with servers, networks, systems, or other infrastructure used to provide the Services;

  • Harass, threaten, impersonate, abuse, or intentionally harm other users where the applicable Service includes social or interactive features;

  • Submit offensive, unlawful, misleading, or otherwise inappropriate player names, profile information, or other user-provided content;

  • Violate the privacy, intellectual property, or other legal rights of HMA Games or any third party;

  • Use HMA Games' trademarks, copyrighted materials, game assets, or other intellectual property without authorization, except as permitted by applicable law;

  • Attempt to obtain unauthorized access to another user's data, player profile, purchases, or Service functionality; or

  • Use a payment method that you are not authorized to use.

You are responsible for your conduct while using the Services and for complying with any applicable platform rules relating to your use of the Services and in-app purchases.

If you materially violate these Terms, engage in fraudulent or unlawful activity, cheat, abuse the Services, or threaten the security or integrity of the Services, HMA Games may take reasonable action, including restricting, suspending, or terminating your access to some or all of the Services, subject to applicable law.

7. Payments, Virtual Currency and Virtual Items

Certain Services may allow you to purchase or obtain virtual currency, virtual items, premium features, passes, boosters, or other digital content (collectively, "Virtual Items").

Virtual Items are provided solely for personal, non-commercial use within the applicable Service.

7.1 Virtual Items

Virtual Items:

  • Have no monetary value outside the applicable Service;

  • Cannot be redeemed for cash or other real-world value unless expressly required by applicable law;

  • May not be sold, transferred, traded, or exchanged outside the Service unless HMA Games expressly permits such functionality;

  • May be subject to limitations, expiration periods, availability rules, or other conditions disclosed within the applicable Service; and

  • Are licensed to you for use within the applicable Service rather than sold as physical property.

HMA Games may modify, rebalance, replace, suspend, or discontinue Virtual Items or related game features where reasonably necessary for gameplay, technical, security, legal, or operational reasons.

Where such changes materially affect purchased Virtual Items, HMA Games will act in accordance with applicable law and any mandatory consumer rights that apply.

7.2 Purchases

Purchases made through third-party platforms, including Google Play and the Apple App Store, are processed by the applicable platform provider and are also subject to that provider's payment terms, billing rules, and policies.

You are responsible for ensuring that you are authorized to use the payment method associated with a purchase.

Prices, taxes, available products, and payment methods may vary by platform, country, currency, or other applicable factors.

7.3 Refunds

Refund eligibility is subject to the policies of the platform through which the purchase was made and to applicable consumer protection law.

Where a purchase is made through Google Play or the Apple App Store, refund requests may be handled by the applicable platform provider in accordance with its refund policies and applicable law. Where permitted by the platform, HMA Games may also assist with purchase-related issues using the tools made available by that platform.

Nothing in these Terms limits any refund, cancellation, repair, replacement, price reduction, or other remedy that cannot lawfully be excluded under applicable consumer protection law.

7.4 Suspension, Termination and Unused Virtual Items

If your access to a Service is suspended or terminated because of fraud, cheating, abuse, unauthorized payment activity, or a material violation of these Terms, you may lose access to Virtual Items associated with that Service, subject to applicable law.

If HMA Games permanently discontinues a Service or materially changes access to purchased Virtual Items, we will handle affected purchases and Virtual Items in accordance with applicable law and any mandatory platform requirements.

Virtual Items that are free, promotional, earned through gameplay, or otherwise provided without payment may be modified, removed, or discontinued as part of normal game balancing, feature changes, or Service updates, subject to applicable law.

8. Prohibited Uses

You may not use the Services in any manner that interferes with their intended operation, compromises their security or integrity, violates applicable law, or provides an unauthorized advantage.

Prohibited activities include, without limitation:

  • Accessing or attempting to access the Services, systems, servers, accounts, player data, or functionality without authorization;

  • Using the Services for unlawful, fraudulent, abusive, or deceptive purposes;

  • Cheating, exploiting bugs or vulnerabilities, manipulating gameplay, scores, rankings, rewards, virtual currency, or game progression;

  • Using bots, automation tools, modified applications, emulators configured for abuse, cheats, hacks, scripts, or unauthorized third-party software to alter or interfere with the Services;

  • Modifying, reverse engineering, decompiling, disassembling, or attempting to derive source code from the Services, except to the extent expressly permitted by applicable law;

  • Circumventing or attempting to circumvent security systems, technical restrictions, access controls, anti-cheat systems, purchase verification, or other protective measures;

  • Interfering with, disrupting, overloading, damaging, or impairing the Services or the infrastructure used to provide them;

  • Hosting, distributing, reproducing, or providing unauthorized versions of HMA Games' games, applications, servers, or Services;

  • Selling, transferring, exchanging, duplicating, or otherwise distributing Virtual Items, virtual currency, player data, or Service access where such activity is not expressly authorized by HMA Games;

  • Attempting to manipulate or fraudulently obtain in-app purchases, advertising rewards, refunds, virtual currency, Virtual Items, or other benefits;

  • Transmitting malware, viruses, malicious code, or other harmful technologies through or in connection with the Services; or

  • Encouraging, assisting, or enabling another person to engage in any prohibited activity described in these Terms.

HMA Games may investigate suspected violations and may take reasonable and proportionate action where appropriate, including restricting, suspending, or terminating access to some or all of the Services.

Serious violations, including fraud, unauthorized access, security attacks, or other unlawful conduct, may also be reported to relevant platform providers, payment providers, or competent authorities where appropriate and permitted by applicable law.

Nothing in this Section restricts activities that cannot lawfully be prohibited under applicable law.

9. Use of Software and User Content

9.1 User Content

Certain Services may allow you to submit or display limited information, such as a player nickname, profile information, feedback, or other content ("User Content").

You are responsible for the User Content you provide through the Services.

You agree that your User Content will not:

  • Violate applicable law;

  • Infringe the intellectual property, privacy, publicity, or other rights of any person or entity;

  • Contain unlawful, abusive, threatening, hateful, obscene, fraudulent, or otherwise inappropriate material; or

  • Attempt to impersonate another person or mislead other users.

Where User Content is displayed publicly through features such as leaderboards, other users may be able to view that content.

You retain any rights you may have in your User Content. By submitting User Content where it is necessary for operation of the Services, you grant HMA Games a limited, non-exclusive, worldwide license to host, reproduce, display, and process that User Content solely as reasonably necessary to operate, provide, moderate, secure, and improve the applicable Service.

HMA Games may remove or restrict User Content that violates these Terms, applicable law, or the rights of others.

9.2 Limited License to Use the Services

Subject to your compliance with these Terms, HMA Games grants you a limited, personal, non-exclusive, non-transferable, and non-commercial license to download, install, access, and use the Services for personal entertainment purposes.

This license does not transfer ownership of the Services, software, game assets, trademarks, copyrights, or other intellectual property to you.

Except where expressly permitted by HMA Games or applicable law, you may not reproduce, distribute, sell, sublicense, commercially exploit, or otherwise use the Services or their content outside the scope of this license.

Any rights not expressly granted to you under these Terms are reserved by HMA Games and the applicable rights holders.

9.3 Suspension and Termination of Access

HMA Games may restrict, suspend, or terminate your access to some or all of the Services, or to a player profile or related online functionality, where reasonably necessary because of:

  • A material violation of these Terms;

  • Fraud, cheating, abuse, or manipulation of the Services;

  • Unauthorized payment or refund activity;

  • Security threats or unauthorized access;

  • Illegal activity; or

  • Other conduct that materially harms HMA Games, the Services, or other users.

Where appropriate, HMA Games may also remove or restrict access to content or functionality associated with such violations.

Any suspension or termination will be handled subject to applicable law and any mandatory consumer rights.

If a Service itself is discontinued rather than your access being terminated because of misconduct, any purchased digital content or Virtual Items affected by that discontinuation will be handled in accordance with Section 7 of these Terms, applicable platform requirements, and applicable law.

10. Copyright Infringement

HMA Games respects the intellectual property rights of others and expects users of the Services to do the same.

If you believe that content available through or in connection with the Services infringes your copyright or other intellectual property rights, please contact us at:

To help us review your notice, please include sufficient information to identify the alleged infringement, such as:

  • Identification of the copyrighted work or other protected material you believe has been infringed;

  • Identification and location of the allegedly infringing material within the Services;

  • Your name and contact information;

  • A statement explaining the basis of your claim and your good-faith belief that the disputed use is not authorized by the rights holder, its agent, or applicable law;

  • A statement that the information provided in your notice is accurate and that you are authorized to act on behalf of the relevant rights holder, where applicable; and

  • Any additional information reasonably necessary for us to evaluate the claim.

HMA Games may request additional information where reasonably necessary to investigate a notice.

Where we determine that content infringes intellectual property rights or otherwise violates applicable law or these Terms, we may remove, restrict, or disable access to the relevant content where appropriate.

We may also take appropriate action against users who repeatedly or materially infringe the intellectual property rights of others, subject to applicable law.

11. Apple App Store

If you download or use a Service through the Apple App Store, your use of the applicable application is also subject to Apple's applicable App Store terms and Apple's Standard End User License Agreement ("Standard EULA"), unless a separate custom end-user license agreement is provided for that application.

These Terms govern your relationship with HMA Games regarding the Services. Apple is not a party to these Terms between you and HMA Games.

You must also comply with any applicable third-party terms and platform rules when using the Services through Apple devices or the Apple App Store.
